Terms of Application

By agreeing to these terms (e.g., by clicking a button to accept these Terms of Application), you, in your individual capacity, represent and agree to the following:

IMPORTANT: THIS AGREEMENT CONTAINS AN ARBITRATION PROVISION, A CLASS ACTION WAIVER, AND A JURY WAIVER. YOU MAY OPT OUT AS DESCRIBED BELOW.

  1. Authorization and Accuracy

    • You are authorized to submit this application, accompanying documents, and provide necessary consents on behalf of yourself and the business listed in the application (collectively, the “Applicant”).
    • You confirm all information submitted to JG Bold, LLC (“JG Bold”) and third-party lenders or financial institutions (“Recipients”) is accurate and complete. Any changes must be promptly reported.
  2. Application Submission

    • This application is being submitted to JG Bold and Recipients for commercial loans or receivables financing. If approved, you are authorized to sign relevant business financing documents, some of which may require a personal guaranty.
  3. Information Sharing and Consent

    • JG Bold and Recipients may share information about the Applicant, excluding consumer credit reports, for administrative, marketing, and servicing purposes, as permitted by law.
    • You consent to the sharing of your personal information with the Applicant during the underwriting process.
  4. Arbitration and Class Action Waiver

    • Any disputes between you and JG Bold will be resolved through binding arbitration, which is more informal than court proceedings. Arbitration does not allow for class actions or collective claims.
    • You waive your right to participate in any class action or similar representative proceeding.
  5. Opt-Out Option

    • You may opt out of the arbitration agreement by submitting a written Opt-Out Notice within 30 days of accepting these terms. The notice must include your name, address, and relevant account details and be mailed to:

  6. Exceptions and Legal Venue

    • Certain legal actions, such as enforcement through federal or state agencies or intellectual property disputes, may proceed in court. Arbitration hearings will take place in Florida, USA, unless otherwise agreed.
  7. Federal Compliance

    • Federal law requires verifying the identity of all individuals and entities opening an account, including name, address, date of birth, and identification number. Additional documents may be requested.

IMPORTANT: This application is for a commercial loan or receivables financing. Funds cannot be used for personal, family, or household purposes.
